These Terms & Conditions ("Terms") govern your purchase of products from lucastefanelli.photography/shop (the "Shop"), operated by Luca Stefanelli Studio, CVR DK45009734, Ørestads Boulevard 126B, 10.5, 2300 Copenhagen, Denmark ("we", "us", "our"). By placing an order, you agree to these Terms.‍ ‍

1. Who we are

We sell fine art photography posters, printed to order and shipped by our print-on-demand partner, Printumo, on our behalf. Products are made when you order them; standard designs can be customized with your choice of size, passepartout (mat), and framing.

2. Orders and contract formation

  • Placing an order through the Shop is an offer to buy. A contract is formed once we send you an order confirmation email.

  • We reserve the right to refuse or cancel an order (e.g. suspected fraud, pricing errors, or stock/production issues), in which case you will be refunded in full.

  • You are responsible for providing an accurate delivery address and contact details.

3. Prices and payment‍ ‍

  • All prices are shown in the currency displayed at checkout and include applicable VAT unless stated otherwise.

  • Payment is processed securely at checkout via our payment provider. Your order will only be produced and shipped once payment is confirmed.

  • We reserve the right to correct pricing errors before an order is confirmed.

4. Made-to-order products

Each poster is printed specifically for you after you place your order, based on the size, passepartout, and framing options you select from our standard catalog. Please double-check your selections before completing checkout, as production begins shortly after ordering.

5. Right of withdrawal (EU customers)

‍If you are a consumer ordering from within the EU, you generally have a 14-day right to withdraw from your purchase without giving a reason, starting from the day you (or someone you nominate) receives the goods.

Because our posters are produced to order based on options you choose (size, passepartout, framing), this right may not apply where the product is considered "made to your specifications" or "clearly personalized" under Article 16(c) of EU Directive 2011/83. Whether a given order qualifies for this exception can depend on how customized the item is. Where the exception does not apply, you may cancel and return your order within 14 days of delivery, in original, unused condition, at your own cost, for a refund of the product price (excluding original shipping costs). ‍

Regardless of the above, your statutory right to a remedy for goods that arrive damaged, defective, or not as described is never excluded — see our Shipping & Returns policy for how to report this.

6. Intellectual property

All photographs, designs, and content on the Shop are the copyright of Luca Stefanelli Studio / Luca Stefanelli. Purchasing a poster grants you ownership of the physical print only — it does not transfer copyright, and you may not reproduce, resell, or use the image commercially without written permission.‍ ‍

7. Liability

  • We are liable for defective or damaged products as described in our Shipping & Returns policy and under applicable Danish consumer law.

  • To the extent permitted by law, we are not liable for indirect or consequential losses arising from your use of the Shop or products.

  • Nothing in these Terms limits any liability that cannot legally be limited or excluded, including liability for fraud or death or personal injury caused by negligence.

8. Delivery‍ ‍

Estimated delivery times and shipping costs are set out in our Shipping & Returns policy. Risk in the goods passes to you once they are delivered to the address you provided.

9. Complaints and dispute resolution

If you have a complaint, contact us first at luca@lucastefanelli.dk so we can try to resolve it directly. EU consumers may also use the European Commission's Online Dispute Resolution platform (ec.europa.eu/consumers/odr) or contact the Danish Center for Consumer Complaints (Center for Klageløsning / Forbrugerklagenævnet).

10. Governing law‍ ‍

These Terms are governed by Danish law. Disputes that cannot be resolved amicably are subject to the jurisdiction of the Danish courts, without prejudice to any mandatory consumer protections available to you in your country of residence.

11. Changes to these Terms

We may update these Terms from time to time; the version in effect at the time you place an order applies to that order.
